Standard Conditions
N.B. PEL Conditions 1 and 2 are no longer relevant to this licence.
3. Police Constables for the County, authorised Officers of the Fire Authority and authorised Officers of the District Council shall, whilst on duty, be allowed to enter the licensed premises at all reasonable times, without payment.
4. Any fire prevention and safety measures that may be required by the County Fire Officer from time to time, must be complied with.
5. All fire fighting equipment, emergency lighting system and means of escape in case of fire must be regularly maintained and tested as required by the County Fire Officer.
6. Seating Units
6.1 Appearance and State of Furniture
All furniture should be kept in a good state of repair and seating units should be checked after each performance to ensure that no ignition sources are present. Torn covers must be removed and repaired immediately.
Those items of furniture which contain combustible foam should, wherever possible, be treated with a fire retardant substance to achieve and maintain non-flammable properties.
(Note: The advice of the manufacturers or of a reputable upholsterer should be sought before arrangements are made for any fire retardant works to be carried out).
2 Replacement and/or Refurbishment of Furniture
When settees, armchairs and other soft furnishing units are replaced or refurbished, combustion modified high resilient foam or equivalent must be used in an in-fill material and covers or barrier cloths must meet the appropriate British Standard.
7. Real or artificial smoke shall not be produced on the premises without the prior approval of the Licensing Authority.
8. The licensee must inform the Licensing Authority at least 7 days prior to a performance of the intention to use laser display equipment. The licensee will be responsible for ensuring compliance with Health and Safety Executive Guidance Note HSG (G) 95.
9. Overcrowding in such numbers as to endanger the safety of staff, patrons or performers shall not be allowed on any part of the licensed premises and the maximum number of persons permitted at any time shall not exceed the number prescribed by the Fire Officer.
10. The licensee shall take all precautions for the safety of the public and performers whilst on the premises and shall ensure that the licensed premises and any fittings, stairways, notices are maintained in good order and condition.
11. Whilst the premises are being used under the terms of this licence, all passages, gangways and fire exits and doors must be kept free of obstructions and the latter must remain unlocked.
12. No alteration shall be made to the structure of the licensed premises or the arrangement of public accommodation or exits without the written consent of the Licensing Authority given under this Act.
13. The licensee or the person in charge of the premises shall maintain and keep good order and decent behaviour on the licensed premises and shall not permit drunkenness.
14. No exhibition, advertisement, recitation, singing or dancing which is obscene, immoral, offensive to public decency or calculated to incite any breach of the peace shall be permitted on the licensed premises.
15. The licensee or person in charge shall be responsible for designating official stewards and shall ensure that one such steward (excluding cashiers and doormen) is in attendance for every two hundred and fifty persons in the premises. The steward(s) shall remain on duty inside the licensed premises during the whole time that the public are present and shall ensure that the approved capacity of the premises is not exceeded.
16. When a particular function at the licensed premises is organised by a person other than the licensee such person shall be responsible for complying with the license conditions.
17. No roller discos must be held on the licensed premises without the prior approval of the Licensing Authority.
N.B. PEL Condition 18 is no longer relevant to this licence.
19. The licensee shall not permit the use of the licensed premises to become a nuisance to persons in the neighbourhood and, in particular, shall take all necessary precautions to prevent persons in the neighbourhood being disturbed by noise. The licensee shall comply with any noise standard specified by the Licensing Authority.
20. When required by the Licensing Authority, automatic control of the volume output from any musical equipment shall be installed and set at a level as directed by the Licensing Authority.
N.B. PEL Condition 21 is no longer relevant to this licence.
22. Other Conditions:
All doors and window to be kept closed at the rear of the premises during periods of entertainment.
Electrical Installation
The electrical installation for the whole building, including the emergency lighting system (where applicable) will be inspected and tested every three years in accordance with BS 7671:2001 and certified as satisfactory. In addition the installation will be fitted a Residual Current Device and the certificate will indicate accordingly. All certification will be certified by a competent person/business having one of the qualifications shown below:
Chartered Electrical Engineer
Approved Electrical Contractor on roll of National Inspection Council for Electrical Contracting
A Member of Electrical Contractors Association
Where remedial works or other action recommended by the competent electrical contractor is
brought to the notice of the licence holder, these will be notified to the licensing authority and
carried out within a reasonable period of time after consultation with the licensing authority.
Management of Unlawful Substances in Licensed Premises
23. A drugs policy in respect of the premises must be submitted the Licensing Authority. Such policy will set out the procedures to be carried out for searching customers for drugs on entry to the licensed premises, the procedure for dealing with drugs found within the licensed premises and for dealing with anyone found using or supplying drugs on the premises. An example of a drugs policy is set out at Appendix 2 to the East Lindsey Community Safety Partnership document dated February 2000.
24. The Licensee shall at all times ensure that the drugs policy referred to above is complied with.
25. A hard-bound record book or register must be kept by the Licensee on the licensed premises to record all drugs seizures, finds and collections together with details of the member(s) of staff involved, police officer(s) to whom the drugs are released and if known details of the user or dealer involved. The register must be made available to the Licensing Authority and to the Police upon request.
26. The Licensee shall have on the licensed premises a deposit box approved by the Police and this shall be used for the storage of any drugs found within the premises pending collection of the drugs by the Police.
27. An appropriate storage facility shall be provided by the Licensee at the licensed premises for the storage of needles or sharps pending collection by the Police.
28. The Licensee shall inform the Police of any drugs seizures or finds within the licensed premises as soon as practicable thereafter.
29. An appropriate cool room/area with seating shall be provided by the Licensee within the licensed premises which must be cooler and quieter than the dancing areas.
30. A pure and wholesome cold water supply which is free of charge shall at all times be provided to not less than one drinking water tap or fountain within each unit of sanitary accommodation provided for the use of patrons within the licensed premises. The cold water supply shall not exceed 25C when derived direct from the mains supply and should not exceed 20C when derived from the approved water storage system. Each drinking water point shall be clearly identified by a conspicuous legible notice stating "drinking water". The water shall be sufficient to allow both hygienic use of the facility and an adequate flow. The Council reserves the right to carry out an analysis of the cold water supply to the licensed premises to test whether it is pure and wholesome. Supplies of water to wash hand basins shall not be delivered to wash hand basins by a single tap providing warm water without prior approval of the Council.
31. The Licensee must operate an effective counting system to monitor the numbers of patrons entering the licensed premises.
32. The Licensee shall ensure that adequate first aid and medical provision is available on the licensed premises. Such provision shall be approved in writing by the Chief Executive for Ambulance Services in Lincolnshire.
Door Supervisors (SIA)
33. The Licensee must provide SIA registered door supervisors at the licensed premises.
34. Door supervisors must display their SIA identification badge at all times whilst on duty at the licensed premises.
35. The Licensee shall maintain a record of the name, address and registration number of each SIA door supervisor, the time and date of commencement of periods of work together with a brief record of any incident. The record shall be retained for a period of eighteen months following the last entry in the book.
Closed Circuit Television
36. A closed circuit television camera shall be located at the licensed premises in a position agreed with the Council in consultation with the Police.
37. The camera shall be: -
(a) secured in a manner approved by the Council in consultation with the Police as to prevent movement, damage or interference whether inadvertent, accidental or malicious; and
(b) positioned to provide a clear field of view of patrons as they enter and leave the licensed premises with the object of achieving a full face and full height picture of patrons as they enter the premises;
38. The video surveillance shall be carried out using a colour recording system;
49. A colour camera shall be used having a high resolution of not less than 400 lines and preferably 450 lines or greater;
40. The camera shall either: -
(i) have an electronic iris (E1) system; or
(ii) be capable of driving a motorised iris lens system
41. The lens of the camera shall be of good quality. The aperture shall have a minimum size of f.1.4 or better and the focal length of the camera lens shall be capable of providing a picture with a vertical component showing the full height of patrons as they enter the premises.
42. The video recorder shall be of good VHS standard having the capability of providing high grade recording using a minimum of two rotary heads;
43. The video recorder shall be used in a real-time, long play mode for all occasions of up to six hours when the public are on the licensed premises;
44. If recording periods in excess of six hours are required, either: -
(i) a twelve or twenty-four hour time lapse mode shall be used as appropriate, or
(ii) two video recorders, both operating up to six hour real-time, long play mode, shall be used. The second recorder shall be set to commence recording at least fifteen minutes prior to the time that the first recorder is due to finish.
45. If the signal for both recorders is derived from the same camera then split during the period that both recorders are operating, an amplifier shall be provided to enhance the signal in order that the signal strength being received by both operating recorders is of the same quality as that when only one recorder is operating.
46. A time/date generator shall be provided and used for each period of operation, showing the correct information on the recording.
47. Tape changes during recording periods are not permitted unless the Council or the Police have been informed in accordance with the verbal notification procedure details in paragraph 62 below.
48. The tapes used for recording shall be of 180 minute recording time (i.e. E180) and they shall be of good VHS standard of high grade quality.
49. There shall be provided one tape for each period of operation and each tape shall be clearly identified by the day of commencement of use.
50. Unless previously specified in writing by the Licensing Authority each tape shall be used for recording a maximum of thirty times before being replaced.
51. The cassette of each tape shall be permanently and indelibly marked with the date upon which it is brought into use and a label shall be provided on the tape upon which shall be clearly marked the date mentioned above and the projected date which will be the last operational use of the tape for video surveillance purposes.
52. The recording of each period of operation shall be preserved for a period of not less than twenty-eight days after completion of recording.
53. Tapes used for these surveillance purposes shall be made immediately available upon request by the Council or any police officer.
54. The lighting levels in the field of view of the camera shall be sufficient to illuminate the front of patrons as they enter the licensed premises to a value of not less than 25 lux.
55. The lighting shall be arranged so as to avoid excessive shadow or glare in the field of view of the camera.
56. Back or external lighting shall be eliminated, reduced or compensated for so as not to adversely affect the pictures resolution or a back light compensating camera shall be used.
57. A colour monitor shall be provided at the licensed premises to enable the procedures detailed below to be carried out.
58. The monitor shall be available to the Council or the Police when carrying out inspections of the equipment.
59. Where facilities are provided for split screen monitoring it shall be ensured that this does not interfere with the continuous recording of the entrance(s) exit(s) as detailed below during the time that the public is on the premises.
60. Maintenance of all the equipment shall be carried out on a regular basis so as to ensure that the equipment is at all times kept in proper working order in accordance with the above specifications.
61. In the event of failure of the video surveillance system the Licensee shall verbally inform the Council and the Police. If the staff of both the Council and Police are unavailable the Police Control Room at the East Division, Police Headquarters (tel: 01754 762222) shall be informed and an incident number for the notification shall be requested.
62. Documented management procedures shall be utilised to ensure the efficient and satisfactory use of the video surveillance equipment. These procedures shall include defined instructions in connection with: -
(a) switching on the lighting
(b) switching on the equipment
(c) insertion of the correct tape for the period of operation
(d) testing the satisfactory working order of all the equipment and ensuring the accuracy of the time/date generator information on the tape before the commencement of the period when the public will be allowed admittance to the licensed premises and
(e) signing of the appropriate daily records and confirmation of the above actions.
63. Items 36 to 62 are the minimum equipment. Further expansion of the video surveillance equipment is recommended after consultation with the Council and the Police.
Annex 2 – Conditions Consistent With the Operating Schedule
General
These premises will employ SIA registered door supervisors, they will be supplied with walkie talkies.
The premises will be covered by a CCTV system.
The Prevention of Crime and Disorder
A drugs policy to be in place and signs to be displayed within the premises advising customers of the policy.
Public Safety
Capacity limits are set (see Public Entertainment Section)
The Prevention of Public Nuisance
The premises are sound proofed, all windows have been blocked off to reduce noise and the premises abut a public road thereby causing no nuisance to neighbours
The Protection of Children from Harm
Adult entertainment will not be provided.
A proof of age policy to be applied with the accepted means of proof being:
Passport
Photo Driving Licence
A recognised valid photo-id card bearing the PASS hologram
Any future accredited and accepted proof of age as defined by Lincolnshire Police.
Annex 3 – Conditions Attached After a Hearing by the Licensing Authority
The following conditions relate to the whole of the venue known as the Sealands Hotel (27 April 2009).
Music/amplified sound should not be audible within any noise sensitive property/caravan with the windows open in a typical manner for ventilation (This condition will relate to the period of time covered by the extension in hours for regulated entertainment contained in the premises licence variation applications granted on 3 May 2006 and 27 April 2009 respectively).
PPN7
There shall be placed at all exits from the premises (and in any outside area/beer garden used for consumption) in a place where they can be seen and easily read by the public, notices asking customers to respect the needs of local residents and requiring customers to leave the premises and the area quietly. (Note, this may also include a reference to vehicles).
PPN9
Door supervisors and other members of staff to request customers to leave quietly and have respect for their residential neighbours.
