The Prevention of Crime and Disorder
There shall be provided door supervisors at the premises as follows:
Lower & ground floor
On Saturday and Sunday of any Bank Holiday weekend,
On every Saturday from the 1st Saturday in July until the 2nd Saturday in September inclusive,
On any Christmas Eve falling on a Friday,
On New Year’s Eve; then
from 2300 hours until closure, a minimum of 1 door supervisor and an additional door supervisor from 0000 hours until closure;
from the 1st Saturday in July until 2nd Saturday in September from 2300 until closure, a minimum of 1 door supervisor on the point of entry located in Grand Parade.
At all other times, there shall be provided at the premises on these floors, door supervisors to such a number, if any, as the management of the premises consider are sufficient to control the entry of persons to the premises and for the keeping of order.
Any door leading into Edinburgh Avenue will operate as a Fire Exit only and not a point of entry.
First, second and third floors
There shall be provided at the premises door supervisors to such a number, if any, as the management of the premises consider are sufficient to control the entry of persons to the premises and for the keeping of order in the premises when the first and/or second and/or third floor are open,
Except for every Thursday when the 1st floor is open between 1st July and 30th September inclusive, when there shall be a minimum of 1 door supervisor from 2300 hours until closure and an additional door supervisor from 0000 hours until closure.
When door supervisors are employed:
A record/log book shall be kept on the premises by the Designated Premises Supervisor of every person employed on the premises as a door supervisor.
The record shall contain the following details:-
The door supervisor's name;
His/Her Security Industry Authority Licence Number
The time and date he/she commenced and concluded their duty
The door supervisors shall sign each entry
The Designated Premises Supervisor or other authorised person shall also endorse each entry as having checked the authenticity of the individual door supervisor.
That record shall be available for inspection on demand by an Authorised Officer of the Council, the Security Industry Authority or a Police Constable.
Each entry shall be retained for a period of 12 months from date of completion.
CCTV must be installed to the satisfaction of Lincolnshire Police. The CCTV specification may not be reviewed by Lincolnshire Police within 5 years of the agreed specification.
The CCTV must be maintained to the standard of the initial installation.
Recordings must be kept for a minimum of 31 days.
An authorised officer may at any time request a recording which must then be surrendered upon request so long as any request is consistent with the provisions of the Data Protection Act 1998 and Human Rights Act 1998
A member of staff shall be identified as responsible for the system and daily checking.
Any instances of crime and disorder to be reported to the local police.
An incident book shall be kept on the premises by the Designated Premises Supervisor recording every incident of crime and disorder involving the premises, staff, customers or door supervisors.
The Incident book shall contain the following details;
Time, date and location of incident.
Nature of the Incident
Names, addresses and contact details of persons involved.
Result of the incident
Action taken to prevent further such incidents.
Each entry signed by the DPS or other responsible person employed at the
premises and so authorised by the DPS.
The Incident Book shall be made available to Police upon request.
Each entry shall be retained for a period of 12 months from date of completion.
If a licensable activity takes place on the first, second or third floor, there shall be seating provided on the floor where the licensable activity is taking place. The seating must be provided whilst the licensable activity is taking place and for a minimum of 50% of the total occupancy figure of the floor.
When Boxing or Wrestling occurs the following conditions take effect:
All drinks must be served in polycarbonate glassware on the first and second floors. When the boxing or wrestling bout is taking place, this condition is not applicable prior to a bout for example during a pre bout meal.
Any boxing or wrestling event will only take place if arranged via a company that is affiliated to a UK boxing or wrestling association and that the event is run in accordance with terms and conditions as stipulated by any such association.
When any event is planned where the event involves the whole of the licensed area the premises licence holder or DPS shall notify the East Division Police Licensing officer of such event within 14 days of the event taking place.
Public Safety
A tamper resistant CCTV system shall be installed, maintained in working order and operated at the premises. The images recorded will be made available to the Police upon request.
No glass drinking vessels, glass bottles or containers made of glass to be taken onto any of the balconies on any floor between 2100 Hours and closure.
The Prevention of Public Nuisance
Signage asking customers to 'please leave quietly' to be displayed when customers are leaving in the early morning.
When live or recorded music is taking place between 2300 and 0700, all external doors and windows shall be kept closed between these times whilst the activities are taking place, save for entry & exit to the premises.
The Protection of Children from Harm
The premises will operate a Challenge 25 policy. People that are known as being over 18 or have previously been asked for proof of age will not be required to continually produce any proof of age.
A proof of age policy supplied by Kurnia, as previously agreed and deposited with Lincoln Police, is to be applied. The accepted means of proof being:
Passport
Photo Driving Licence
A recognised valid photo-id card bearing the PASS hologram
Any future accredited and accepted proof of age as defined by Lincolnshire Police.
No activities are proposed that may give rise to concern in respect of children but should any activities occur that may give rise to concern in respect of children then suitable measures and restrictions shall be implemented.
Annex 3 – Conditions Attached After a Hearing by the Licensing Authority
The following conditions were attached following a review hearing held 28th August 2012:-
1. Members of the public not to be permitted on the front areas of the balconies shaded orange (on the attached plan) on the first floor, second floor and third floor balconies between the hours of 2300 and 0600 hours and fixed barriers to be installed at the points marked in blue (on the attached plan) on the first floor, second floor and third floor balconies between the same hours.
2. A net or something similar so as to stop objects being thrown towards Grand Parade, to be installed vertically between the top of the fixed barrier (on the first floor) and the lower side of the second floor balcony.
3. When events take place on the second or third floor, where the management deem it necessary via risk assessment a net or something similar so as to stop objects being thrown towards Grand Parade, to be installed vertically.
4. When events take place on any floor, where the management deem it necessary via risk assessment a door supervisor shall be in place on the appropriate balcony.
5. Any risk assessments undertaken to be recorded in writing and kept and maintained for 12 months. Such records to be made available for inspection by any Responsible Authority.
