ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
General
Staff and management shall receive training, and refresher training every twelve months, in relation to licensing legislation, underage sales and drugs policies and shall be fully conversant with the conditions attached to the Premises Licence.
Function Room - The Function Room, as marked on the plan deposited with the Licensing Authority, will not be used for day to day operations and will only be used for pre-booked or pre-arranged functions. The door between the function room and the bar area will be alarmed so as to alert staff if patrons try to enter the area when it is not being used (the door cannot be locked as it is part of the fire exit). There will be sufficient staff on duty to supervise this area and ensure it is not be used for any illegal activities.
Prevention of Crime and Disorder
A CCTV system shall be installed, recording and maintained in working order and operated at the premises to the satisfaction of Lincolnshire Police, specifically:
a) There shall be sufficient cameras able to cope with the normal operating illumination to reasonably cover all licensed public areas.
b) Recordings must be kept for a minimum of 28 days and endorsed with the accurate, correct time/date (BST/GMT adjusted).
c) Police and/or Authorised Licensing Officers shall be able on attendance to view immediate playback of any incident without the necessity for download.
d) Recordings of incidents at the premises must be provided to the Police following lawful request.
e) A member of staff shall be on the premises at all times they are open to the public who is capable of operating the CCTV system and providing recordings on request. When this is not
possible recordings shall be provided within 24 hours of the original request.
f) Recording equipment shall be housed in a secure room/cabinet where access and operation is strictly limited to authorised persons.
g) All equipment shall have constant time/date generation, which must be checked for accuracy on a daily basis.
h) The CCTV system should be maintained and checked every 12 months, with the installing company, or if this is not possible another reputable company, producing a letter of compliance.
i) In the event of a system malfunction, the Designated Premises Supervisor (DPS) or the Premises Licence Holder must immediately notify the Licensing Authority and the Police Licensing Department. Details of this malfunction must be recorded in the premises refusals/incident book. Arrangements for its repair must be made without delay. The Licensing Authority and Police Licensing Department must be notified when the system is again operational.
j) Police and/or Authorised Licensing Officers shall be able on attendance to view immediate playback of any incident without the necessity for download.
k) There will be no use of smoke machines or other special effects that will affect the operation of the CCTV system.
The CCTV system must comply and be registered with the CCTV Code of Conduct published by the Information Commissioner’s Office (ICO).
When the premises is serving alcoholic beverages, regulated entertainment or late night refreshment between the hours of 23.30 Hours and 06.00 Hours, even if this is with the provision of a Temporary Event Notice (TEN), there shall be provided at the premises a minimum of 2 SIA registered security personnel. At all other times there shall be provided at the premises SIA registered security personnel to such a number, if any, as the management of the premises consider are sufficient to control the entry of persons to the premises and for the keeping of order in the premises and ensuring the safety of the public when they are used for a licensable activity.
There shall be provided and kept at the premises a register/log book to record details of every person employed on the premises as a door supervisor. The record shall contain the following
details:
The door supervisor's name;
His/her Security Industry Authority (SIA) Licence Number;
The time and date he/she commenced and concluded their duty;
The door supervisors shall sign each entry;
The log to be inspected weekly and signed by a member of the management team;
The log to be retained for a period of no less than 12 months and made available to Lincolnshire Police for inspection upon request.
There shall be a drug policy completed for the premises. This document will be specific to the venue and will be kept on site at all times and will be made available for inspection upon reasonable request from any Responsible Authority.
Public Safety
An incident/refusals book shall be kept at the premises, in which details of refusals of sales, crime and/or disorder relating to the premises shall be recorded. The incident book shall contain the following details;
Time, date and location of incident/refusals.
Nature of the incident/refusal.
Names, addresses and contact details of persons involved.
Result of the incident/refusals.
Action taken to prevent further such incidents.
Each entry to be signed by the DPS or other responsible person employed at the premises and so authorised by the DPS; to be retained for a period of no less than 12 months and made available to Lincolnshire Police for inspection upon reasonable request.
All events or functions outside of the normal day to day use of the premises will be risk assessed by the DPS and the provision of polycarbonate or plastic glasses will be available for use if needed. As many of the glass drinking vessels as possible will be toughened glass. There will be a written policy around the use of glass drinking vessels and how the premises will try to prevent injury from them.
Prevention of Public Nuisance
The premises licence holder (or nominated person) will assess the impact of any noisy activities on neighbouring premises at the start of the activity and periodically throughout the activity and take action to reduce noise levels if they are found to be distinguishable above normal background levels at the nearest noise sensitive property.
The premises licence holder (or nominated person) will ensure that the area abutting the premises is regularly cleaned to ensure that litter is removed and properly disposed.
All external doors and windows shall be kept closed (except for normal access and egress) when regulated entertainment is being provided.
Wherever possible the delivery of goods to the premises will be restricted to the normal working day.
When required by the Environmental Health Service of East Lindsey District Council a noise limiting device (the specification and design to be agreed with Environmental Health Service) will be fitted so that all regulated and recorded music is channelled through the device. The maximum noise levels will be set by agreement with the Environmental Health Service and will be reviewed from time to time as appropriate.
Protection of Children from Harm
The premises shall operate the "Challenge 25" Proof of Age Policy to prevent the sale or supply of alcohol to persons under 18 years of age. The policy shall require any person who appears to be under the age of 25 years to produce one of the following forms of identification:
A recognised proof of age card credited under the British Retail Consortiums Proof of Age Standards Scheme (PASS);
Photo driving licence;
Passport.
Notices shall be prominently displayed advising customers of the “Challenge 25” policy
All point of sale staff shall undergo training in the Challenge 25 proof of age scheme and all other relevant policies with a record kept of the date of training, signed by the member of staff and the trainer. Each entry shall be retained for a period of 12 months from date of completion. This record shall be made available for inspection by Lincolnshire Police Officers or other relevant authority.
A notice or notices shall be displayed in and at the entrance to the premises where they can be clearly seen and read and shall indicate that it is unlawful for persons under 18 to purchase alcohol or for any person to purchase alcohol on behalf of a person under 18 years of age.
